Heard Sri Viveka Nand Rai, learned counsel for the petitioner and Sri Naushad Siddiqui, learned Standing Counsel appearing for the State-respondents.
The petitioner who is working on the post of Lekhpal seeks to assail the order dated 22.08.2019 passed by the Sub Divisional Magistrate, Chatta, Mathura whereunder he has been placed under suspension pending initiation of departmental proceedings.
Counsel for the petitioner has sought to assail the order of suspension by stating that the charges referred to in the order are without basis.
Learned Standing Counsel appearing for the State-respondents submits that the recital of the charges in the suspension order is only of a prima facie nature and petitioner would have full opportunity to place his defence during the course of the departmental proceedings. It has also been pointed out that the suspension order itself discloses that an inquiry officer has already been appointed with a direction to submit the inquiry report within a time bound period.
Counsel for the petitioner at this stage makes a prayer that departmental proceedings be concluded expeditiously. He also undertakes that petitioner would cooperate with the proceedings.
Having regard to the facts of the case, the petition is disposed of with an observation that the departmental proceedings initiated against the petitioner pursuant to the order of suspension dated 22.08.2019 shall be proceeded with and brought to a logical conclusion expeditiously, preferably within a period of three months from the date of presentation of a certified copy of this order, subject to cooperation by the petitioner.
