(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by convict through jail seeking temporary bail for a period of 30 days so as to undertake the construction of residential premises for his family and also to arrange for livelihood for his family.

Learned APP, Mr.Pujari, waives service of rule on behalf of respondent-State.
Learned APP has invited attention of the Court to the jail remarks.
The convict is undergoing life imprisonment for offence punishable under Sections 302, 365 and 201 of Indian Penal Code in Sessions Case No.31 of 2010. He was convicted by the judgment and order dated 27.05.2011. By now, he has undergone 2 years, 5 months and 28 days as on 22.5.2012.
It is also mentioned in jail remarks that the application for grant of first furlough is pending with the I.G. (Prison) since September, 2011. The learned APP states that pursuant to that application the Authorities have written letter to District Superintendent of Police, District: Motihari, Bihar and also to Police Inspector of Chiraya Police Station but so far they have not received any response.
Learned APP prays for some time so as to obtain the opinion from the District Superintendent of Police and Police Inspector as aforesaid.
At his request, the matter is adjourned to 27th June, 2012.
