Heard Sri Ganesh Kumar, learned counsel for the petitioners and learned Standing Counsel for respondents No.1 to 3. Notice need not be issued to respondents No.4 to 6 at this stage.
This writ petition has been filed with the following prayer:
"issue a suitable order or direction, in the nature of mandamus directing the respondent no.2 Commissioner, Basti Region Basti to decide the Suit/Appeal No.C-202170000087 (Dukhi Singh & others Versus Ajai Singh and others of Village-Jeevpur, Tappa-Dubalia, Pargana- Amroha, Tehsil -Harraiya, District- Basti, pending in the court of Commissioner, Basti Region Basti, within stipulated period as fixed by this Hon'ble Court."
It is contended by counsel for the petitioners that against the order passed under Section 24 for demarcation proceedings, an appeal under Section 24(4) of the U.P. Revenue Code, 2006 has been preferred by the petitioners, which is pending consideration before respondent No.2. The sole prayer is for early disposal of the aforesaid appeal.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to decide the aforesaid appeal of the petitioners, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
