Heard learned counsel for the applicants, Shri Shiv Saran Tripathi, learned counsel for the opposite party no.2 and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 14.9.2017 in case crime no. 350 of 2017 (State Vs. Dujendra Pratap Singh and others) under sections 452, 323, 506 I.P.C. P.S.Jawan District Aligarh as well as cognizance order dated 24.10.2017 passed by the Additional Chief Judicial Magistrate, court no.4 Aligarh in Criminal Case no. 1717 of 2017.
Learned counsel for the applicants submits that they have been falsely implicated by the police under the alleged sections.
In that view of the matter, they are permitted to move discharge application within three weeks from today through counsel before the trial Court and the trial court shall decide the same within a period of three months from the date of filing of applicant along with certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid direction,the application is disposed of.
