This writ petition has been filed by the petitioners to issue a writ, order or direction in the nature of certiorari quashing the impugned FIR dated 17.4.2019 registered as Case Crime No.0097 of 2019, under sections 4/21 of Mines and Mineral (Development and Regulation) Act, 1957, P.S. Kotwali Chunar, District Mirzapur.
It is submitted by learned counsel for the petitioner that the FIR is barred under Section 22 of the MMRD Act.
The contention on the face of it deserves to be rejected, as the said provision bars cognizance, not the lodging of the FIR.
The writ petition lacks merit and is dismissed.
