This Writ Petition is filed for a Mandamus to declare the action of the official respondents in not renewing the petitioner’s authorization in respect of fair price shop No.27 of Petasannegandla Village, as illegal and arbitrary.
On 25-09-2014, the case was adjourned to enable the learned Assistant Government Pleader for Civil Supplies (AP) representing the official respondents to get instructions.
Today, at the hearing, the learned Assistant Government Pleader has submitted that as the petitioner was appointed as the dealer of the fair price shop in question on temporary basis for a limited period of three months from 01-01-2014 to 31.03.2014, he is not entitled to seek renewal of the same. The learned Assistant Government Pleader is, however, unable to state as to why respondent No.3 is not taking steps for filling up the said vacancy on permanent basis.
In my opinion, making temporary or adhoc arrangements without filling up the vacancy on permanent basis for distribution of essential commodities is neither appropriate nor desirable. Respondent No.3 cannot resort to changing the fair price shop dealers on temporary basis at his whims. For the abovementioned reasons, the Writ Petition is disposed of with the direction to respondent No.3 to fill up the vacancy of the fair price shop in question on permanent basis by following the prescribed procedure within three months from the date of receipt of this order.
As a sequel, WPMP.No.36301 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
