ORDER:
This Company Petition is filed for ordering winding up of the respondent-company.
On behalf of the respondent, an affidavit has been filed by Mr. M. Ramakrishna, Senior Project Manager, wherein while stating that the respondent has taken a demand draft for US $ 1,65,700 = Rs.1 Crore on 27- 3-2014, he has unequivocally undertaken to pay the entire balance principal amount by the end of this year. On the last date of hearing, the demand draft for US $ 1,65,700 was handed over to the counsel for the petitioner by the counsel for the respondent.
In view of the affidavit filed on behalf of the respondent wherein it has undertaken to pay the entire balance principal amount before the end of this year, the Company Petition is closed with liberty to the petitioner to seek revival of the same in the event the respondent fails to clear off the principal amount as undertaken by it. The petitioner is also left free to file a Contempt Case in the event the undertaking given by the respondent is violated.
