Asha, J. The petitioner is challenging Ext.P10 order, which directs him to surrender the passport of the minor child Devika, in I.A.No.2180 of 2014 in O.P(G&W) 954 of 2014. The learned counsel for the petitioner submitted that the petitioner wants to take the child to Mauritius for attending a conference in connection with an international convention of the Lions Club during the first week of December, for which he requires her passport.
2. We heard the learned counsel for the petitioner and the learned counsel for the respondent.
3. We find that the matter is pending before the Family Court, Thiruvananthapuram and the entire materials pertinent to the dispute between the parties are before that court. Therefore it is only appropriate that the petitioner should approach the Family Court if at all any modification of earlier orders are O.P(F.C) No.509 of 2014-R 2 required or any fresh orders are necessary after advancing the case.
4. The petitioner will be free to move the Family Court for appropriate orders. The learned counsel for the petitioner submits that a petition filed for the above relief in O.P(G&W) 954/2014 stands posted to the last week of January, 2015. It is up to the petitioner to move the Family Court to advance that petition or fresh petition for modification of earlier orders passed or otherwise. In that event, the Family Court will pass appropriate orders on the petition, after hearing both sides.
With the above observations, we dismiss the Original Petition(F.C).
