Dr.W.H.Issac Sunder Sen vs The State Of Tamil Nadu

Madras High Court|31 January, 2017

JUDGMENT / ORDER

The Petitioner seeks for disposal of his appeal filed before the first respondent on 6.5.2015 as against the order rejecting gun licence to the Petitioner.
2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader takes notice for the respondents.
3.By consent of both parties, the main Writ Petition is taken up for disposal, at the admission stage itself.
4.The grievance of the Petitioner is that such appeal filed as early as on 6.5.2015, has not been disposed of so far, even though a reminder was sent on 24.5.2016.
5.Needless to say that it is for the first respondent to consider the appeal and pass orders on the same on merits and in accordance with law and therefore, this Court, at this stage, is not expressing any view on the claim made by the Petitioner seeking for such gun licence.
6.Therefore, without expressing any view on the merits of the matter, I only direct the first respondent to dispose of the appeal filed by the Petitioner on 6.5.2015 on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order, if the appeal is not disposed of so far.
7.With the above direction, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
