High Court Of Kerala|17 December, 2014

JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Government Pleader, as well as the learned Standing Counsel for the respondents, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner is presently working as Homoeo Medical Officer (Ayush) at the District Government Homoeo Hospital, Kanhangad, Kasaragod District.
3. On earlier occasion, the petition filed W.P. (C) No.
29299/2013 and invited Exhibit P10 judgment. The said writ petition was filed contending that his request for transfer to Thiruvananthapuram District was not considered. In fact, this Court directed the authorities to consider the petitioner's request for transfer in accordance with law.
4. In compliance with the directions of this Court in Exhibit P10, the second respondent issued Exhibit P11 order placing the matter before the Executive Committee of the State Health & Family Welfare Society (National Health Mission). In that context, the petitioner filed the present writ petition complaining that the second respondent, instead of placing the matter before the Executive Committee, ought to have decided the issue himself.
5. The learned Standing Counsel for the respondents has admitted that it is the Executive Committee which is competent to take decision concerning the request of petitioner for transfer. According to him, the second respondent in strict compliance with the regulations has placed the matter before the said Committee through Exhibit P11 order. He has further, on instructions, submitted that the Committee is to meet in the month of January and then an appropriate decision will be taken by the Committee on the request of the petitioner for transfer.
6. Recording the submission of the learned Standing Counsel for the respondents, this Court disposes of the writ petition with a direction to the Executive Committee of the State Health & Family Welfare Society (National Health Mission) to take a decision on Exhibit P11 order issued by the second respondent as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this judgment.
With the above observation, this writ petition is disposed of.
