JUDGMENT / ORDER

The petitioner was aggrieved by Ext.P4 warrant issued by the Recovery Officer of the Debt Recovery Tribunal for satisfaction of the certificate issued by the Tribunal in D.R.C.661 in T.A.1051/97 between the State bank of India and Sushie Rubber Industries Pvt.Ltd and six others. Petitioners were legal heirs/defendants in the Transfer Application. In any event, the learned senior counsel Sri.Chandran Pillai appearing for the SBI on instructions, submits that with reference to the certificate issued in T.A.1051/97, the dispute has been settled between the Bank and the borrowers and as per the settlement, the borrowers had paid OP(DRT).38/14 2 the entire money. In such circumstances, Ext.P4 shall not be enforceable and the same is set aside. Original Petition allowed.
