The petitioner gifted land measuring 2.75 Acres in Survey Nos.222/3 and 222/7 of Block No.45 of Akalakunnam Village of Kottayam District to the 1st Respondent as per the gift deed produced as Ext.P1. According to the petitioner, he gave the gift for utilising the land for the purpose of constructing houses for the poor and the homeless, named as “Sri. M.T. George Mailady Memorial Housing Complex” under the “Rajeev Ten Lakhs House Construction Scheme”. It is submitted that a neighbouring owner has started steps for utilising the adjacent land for the purpose of quarrying and certain persons have approached this court. Ext.P4 is the judgment. According to the petitioner, in Ext.P4, it is held that this property was given for the construction of houses for homeless and poor under a scheme. It is also submitted that it is open to the petitioner to take steps to re-convey the property if the objectives of the gift has not been performed by the Housing Board. Based on the observations in Ext.P4 judgment, the petitioner has approached the Housing Board by Exts.P5 and Ext.P6. W.P.(C) No.28587/2014 2 2. In the above circumstances, there shall be a direction to consider Exts.P5 and P6 representations by the 1st Respondent within a period of two months from the date of receipt of a copy of this judgment, after affording an opportunity of hearing to the petitioner.
The writ petition is disposed of as above.
