JUDGMENT / ORDER

The petitioner is aggrieved by the low marks granted to the petitioner in the final year Bachelor of Ayurvedic Medicine and Surgery (BAMS) examination. The petitioner seeks further revaluation, not satisfied with the revaluation already conducted. 2. The learned Standing Counsel appearing for the respondent University submits that, there is no provision for a second revaluation. In fact the petitioner, the second rank holder disputed the award of marks in three subjects. Hence, a revaluation was conducted and in the revaluation though there was change in marks, since, the difference was not above 5% as per the regulations of the University. It is in such circumstance the petitioner seeks for a third valuation, which unfortunately is not available in the provisions of the University. A Division Bench decision of W.P.(C) No.25524 of 2014 - M 2 this Court in Sruthi Rajagopal v. Mahatma Gandhi University [2014 (2) KLT 945], has categorically held that, if there is no provision available in the regulations, no valuation can be done.
3. In such circumstance, the third valuation sought for cannot be permitted. The petitioner has a further prayer insofar as seeking for the tabulation sheet to be provided to her. The learned Counsel would submit that it is still available and the same would be given to her, but, after defacing the examiner's name. The tabulation sheet accordingly shall be issued to the petitioner within a period of three weeks, on the petitioner approaching the Controller of Examinations, with an application for such issue.
The writ petition is dismissed, with the above reservation.
