This is a petition filed under Section 24 of the Code of Civil Procedure seeking to have O.P.(G&W) No. 1004/2014 pending before the Family Court, Kottayam transferred to the Family Court, Kollam.
2. Suffice to say that the marital relationship between the petitioner and the respondent ran into rough weather and both instituted proceedings against each other. The petitioner has instituted O.P.No.1068/2014 and O.P.No. 1069/2014 before the Family Court, Kollam.
3. The learned counsel for the petitioner pointed out that as a retaliatory measure, the respondent has instituted O.P.(G&W) No.1004/2014 before the Family Court, Kottayam. It is pointed out by the petitioner that she finds it difficult to go over to the Family Court, Kottayam to attend the routine postings of the case. Moreover, it is pointed out Tr.P.(C) No. 588 of 2014 -2-
that two of the matters are pending before the Family Court, Kollam, it is only proper that both the cases will be tried together so that conflict of decisions can be avoided.
4. Though the respondent was served with notice, there is no appearance.
5. Taking note of the various aspects, especially, the fact that two matters are already pending before the Family Court, Kollam, it is felt that there is no reason to reject the prayer.
This petition is allowed and O.P.(G&W) No. 1004/2014 pending before the Family Court, Kottayam at Ettumanoor shall stand transferred to the Family Court, Kollam.
