JUDGMENT / ORDER

V.K.Mohanan, J.
Learned counsel for the respondent submitted that the respondent had remarried and has an issue in the said wedlock. Learned counsel for the appellant on instruction submitted that though the appellant has got a very good case against the finding of the court below on the allegation of cruelty, the appellant is not interested in prosecuting the appeal, considering the fact that the respondent had already married another lady and got a child in the said lady. In the light of the above submission, we find no ground to proceed with the hearing of the appeal. We have also considered the Mat. Appeal No.738 of 2010 & 2 Cross Objection No.76 of 2011 contentions raised in the cross objection and we find no merit in those contentions.
In the result, the above appeal as well as the cross objection No.76/2011 are stand dismissed.
