JUDGMENT / ORDER

The court below has thought it fit to allow the application for amendment of the plaint in regard to the relief portion. There cannot be an amendment to the relief portion only without the supporting averments in the body of the plaint. The court below ought to have allowed the application for amendment of the plaint in toto in the nature of the contentions in the written statement that defendant No.12 was an employee under the other defendants. 2. I set aside Ext.P3 order and allow I.A.No.1577/2013 in O.S.No.124/2009 on the file of the Munsiff of Parappanangadi. This is however subject to the condition that the petitioner pays a sum of `. 5,000/- as costs to the counsel for the first respondent in this court. The costs shall be paid within two weeks from today failing which the impugned order will remain intact.
The Original Petition is disposed of.
