JUDGMENT / ORDER

This contempt petition (Civil) has been filed alleging wilful disobedience with the directions of this court in judgment dated 2.9.2013 in W.P.(C) No. 9671/2013. Evidently, as per the judgment in W.P.(C) No.9671/2013 this Court directed the first respondent to disburse the retiral benefits legally payable to the petitioner. Admittedly, in purported compliance with the directions in the said judgment the first respondent passed an order bearing No. FIN/5/2/2612/12(i) dated 22.3.2014 finding that the petitioner is entitled to an amount of Rs. 98,980/-. Feeling aggrieved by and dissatisfied with the said order the petitioner has filed a writ petition before this Court as W.P.(C) No.10750/2014. In the said circumstances it is evident that the first respondent has passed an order holding that the petitioner is legally entitled to get only an amount of Rs.98,980/- and steps were also taken for effecting such payment. In the said circumstances and also taking note of the fact that the petitioner C.O.(C) No. 1502 of 2013 2 has already filed the writ petition challenging the said order dated 22.3.2014 and claiming that the calculation made thereunder is culpably wrong. I am of the view that it cannot be said that the respondents have committed wilful disobedience with the directions of this Court in the judgment dated 2.9.2013 in W.P. (C) No. 9671/2013 in view of the aforesaid circumstances.
Therefore, without prejudice to the right of the petitioner to pursue with W.P.(C) No.10750/2014, this C.O.C. is closed.
