JUDGMENT / ORDER

Out of the wed-lock between the petitioner and the respondent, a male child was born and the petitioner-wife is residing in her parents' house along with the child in Omalur, Salem District. The petitioner-wife filed H.M.O.P.No.96 of 2016 before the Sub-Court, Mettur, for restitution of conjugal rights. The respondent-husband had filed H.M.O.P.No.61 of 2016 before the Family Court, Dharmapuri, for dissolution of marriage. It is the grievance of the petitioner-wife that she is unable to attend the Court hearings in Dharmapuri, along with the child and that she could not afford to travel the distance between the said two places, apart from expending for the travel. Hence, she prays for the transfer of the case from Dharmapuri to Salem. Taking into consideration the fact that Mettur is the central place between Dharmapuri and Salem and taking into account the convenience of both parties, this Court deems it fit to transfer the case to Mettur. Moreover, the connected H.M.O.P.No.96 of 2016 is pending before the Sub-Court, Mettur. Accordingly, this Tr.C.M.P. is ordered and H.M.O.P.No.61 of 2016 pending on the file of the Family Court, Dharmapuri, shall stand withdrawn and transferred to the Sub-Court, Mettur. No costs. C.M.P. is closed.
