~ ~ ~ ~ ~ ~ Petitioners challenge order dated 18.06.2014 in Crl.R.P.No.51/2014 passed by the Special Additional Sessions Court (Marad Cases), Kozhikode. It seems that, on a mistaken assumption, the court below has recorded that the revision was not pressed by the petitioners and a memo to that effect was filed. In fact, no such memo was filed and the matter was being hotly contested. It was on that mistaken assumption, the court below has dismissed the Crl.R.P. through Annexure-A6 order. 2. Heard learned counsel for the petitioners and the learned counsel for the contesting respondents.
3. It has come out that no memo was filed as noted by the court below in Annexure-A6 order. The revision was mistakenly dismissed. The said order is liable to be Crl.M.C.3704/2014 : 2 :
quashed.
In the result, order dated 18.06.2014 in Crl.R.P.No.51/2014 passed by the Special Additional Sessions Court (Marad Cases), Kozhikode is quashed. The revision petition is restored and is remitted to the court below for fresh disposal in accordance with law. The parties shall appear before the court below on 22.01.2015.
