JUDGMENT / ORDER

Learned counsel for the applicant files supplementary affidavit and learned A.G.A. files counter affidavit, which are taken on record.
Heard the learned counsel for the applicant and learned A.G.A. for the State as well as perused the documents available on the record.
The accused-applicant Driver Sachin is involved and detained in Case Crime No. 8 of 2010, under Section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, from Police Station Manzhila, District Hardoi and he has applied for bail.
The submission of the learned counsel for the accused applicant is that only one case has been shown in the Gang Chart against the accused applicant in which he is already on bail. The co-accused Atul Kumar Singh and Suman @ Sanjeev Misra have already been ordered to be released on bail by the another Bench of this Court, vide order dated 15.2.2010 and 09.03.2010, passed in Criminal Misc. Case No. 1101 (B) of 2010 and Criminal Misc. Case NO. 1701 (B) of 2010. Therefore, the accused applicant also deserves to be released on bail.
Learned A.G.A. opposed the bail application of the accused applicant.
Considered the submissions of the learned counsel for the accused applicant and the learned A.G.A.
Keeping in view the totality of the facts and circumstances of the case, without expressing any opinion on the merit of the case, the accused applicant may be released on bail.
Let applicant Driver Sachin be released on bail in the aforesaid case crime number on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
