JUDGMENT / ORDER

This contempt case is filed alleging that the respondents herein have willfully disobeyed the direction issued by this Court in Annexure A1 judgment delivered on 27.6.2013 in W.P.(C) No.15344 of 2006. It is contended that though by the said judgment, this Court had directed the respondents to grant advance increments in the existing scale to the petitioner and to disburse the arrears within three months from the date of receipt of a copy of the judgment, the said direction has not been complied with. The petitioner has averred that a copy of the judgment was served on the respondents on 18.7.2013. The stand taken by the second respondent in his affidavit dated 24.1.2014 is that canvassing the correctness of Annexure A1 judgment, the respondents therein have filed W.A.No.1801 of 2013, that it was dismissed by judgment delivered on 9.12.2013, that later a Special Leave Petition was filed and it is pending. 2. When the contempt case came up for hearing today, the learned counsel appearing for the petitioner submitted that to the best of the petitioner's knowledge no Special leave Petition is pending but notwithstanding the said averment in the affidavit, advance Cont. Case (C) No.1400/2013 2 increments were granted and disbursed to the petitioner pursuant to G.O.(Rt)No.769/H.Edn/2014 dated 16.4.2014.
In such circumstances, I am of the opinion that no further orders are called for in this contempt case. It is accordingly closed.
