Petitioner has approached this Court alleging contempt of the directions issued by this Court as per order dated 03.12.2013 in R.C. Rev. No.399/2013. By Annexure 1 order this Court had granted time for the respondent to vacate the premises by 31.10.2014. As per the direction, an affidavit was also filed by the respondent. Learned counsel further submits that by virtue of an application filed by the respondent, time for vacating the premises is extended up to 17.12.2014.
On account of the subsequent event, we are of the opinion that there is no willful contempt on the part of the respondent. The contempt proceeding is dropped without prejudice to the right of the petitioner to pursue the matter, if there is non compliance to vacate the premises after the extended time.
