JUDGMENT / ORDER

The petitioner is the grant son of late Dr.Ephraim Antony Mampilly, who obtained assignment of land in survey No.1112/1 of Kanayannoor Taluk as per Ext.P1 from the Maharaja of erstwhile Cochin Government. The petitioner has approached this Court on account of the refusal to accept basic tax. There is no embargo in alienating or encumbering the property as per Ext.P1. The property is also heritable. The petitioner's grievance is that in revenue records the land is not shown as owned by the petitioner. Therefore, in such circumstance, I am of the view, the District Collector shall take a decision in the matter so as to show the ownership of the property considering the nature of the right held by the petitioner based on Ext.P1. The decision shall be taken by the District Collector after affording an opportunity to the petitioner WP(C).No.24883/2014-I.
2 within a period of two months. Based on such decision, the basic tax shall be accepted from the petitioner.
2. The petitioner also relies on a Government Order GO.(P).No.53/2009/RD, dated 27.1.2009 and submits that this should be treated as a Government land assigned to the petitioner. Therefore decision shall be taken by the District Collector whether this could be treated as a Government land assigned to the petitioner by virtue of Ext.P1.
This writ petition is disposed of as above.
