D.Rekha vs The Deputy Inspector General Of ...

Madras High Court|27 March, 2017

JUDGMENT / ORDER

The prayer in the Writ Petition is for a direction to the 1st respondent to consider the petitioner's representation dated 15.03.2017.
2. It is the claim of the petitioner that after joining CRPF on 01.10.2004, as a General constable, she has served all over the country and important places like Gandhi Nagar, Imphal, Assam, Srinagar and New Delhi and at present, she is working in RTC, Avadi Unit, from 08.05.2013. It is also stated that her husband is also working in Indian Army and now he is in Jammu and she has got two children viz.,Trishit (6 years) and Thakshith (3 years). At this juncture, in the month of September 2016, the respondent-CRPF, has issued an order of transfer transferring her from RTC Avadi to 232(M) Bn u/1 and after giving personal audience to the petitioner for her transfer at choice place and seeking to keep the order of transfer in abeyance and to permit the petitioner to work in the present station, the competent authority granted extension of 6 months till 31st March 2017. Thereafter, the petitioner made a representation dated 15.03.2017 to the 2nd respondent, which according to the petitioner has not been considered till date, has compelled her to visit this court seeking some more reasonable time extension to joint duty at the transferred place.
3. It is submitted by the learned counsel for the petitioner that the petitioner's children are not doing well and her relatives are taking care of the children, while she is going to duty and therefore, at this juncture, if the petitioner is compelled to go to 232(M) Bn, which is far away from the present place and in view of the transfer, her small children and the petitioner would be put to great problem and hence, finally she is requesting this court to give a direction to the respondent to consider her representation dated 15.03.2017.
4. But this court is not inclined to entertain the petitioner's plea seeking a direction to the 1st respondent to consider her representation dated 15.03.2017. It is seen from the order of transfer dated 21.10.2016 that the petitioner has been granted extension of her tenure in RTC AVD till 31st March, 2017 and as such, she having enjoyed the extension of time till 31st March, 2017, now filing this writ petition for a direction to the 1st respondent, to consider her representation cannot be entertained by this court. Hence the Writ Petition is dismissed. No costs.
