Dr.D.Dhanasekar vs Deputy Director Of Health ...

Madras High Court|17 November, 2017

JUDGMENT / ORDER

The petitioner seeks to quash the impugned proceedings dated 20.10.2017 passed by the first respondent / Deputy Director of Health Services, Cuddalore, in and by which, the petitioner was directed to handover the charge to the third respondent.
2. When the matter is taken up, learned Additional Government Pleader appearing for the respondents 1 and 2, by producing a copy of the proceedings dated 17.11.2017 of the first respondent, submitted that the said impugned proceeding directing the petitioner to handover the charge to the third respondent has been cancelled now by the first respondent. It is also his further submission that in view of non-cooperation of the petitioner to take care of the patient suffering from Dengue fever, he was directed to hand over the charge to the third respondent. However, since the said impugned proceeding has been passed without any notice, now, by way of the proceedings dated 17.11.2017, the same has been cancelled. Thus, he pleaded, a liberty may be given to them to proceed against the petitioner, if there are any other grounds available.
3. Recording the above said submissions, since the impugned proceedings has been cancelled, the writ petition is closed with liberty to the official respondents to proceed against the petitioner if there is any other ground made out against him. No Costs. WMP.No.30836 of 2017 is closed.
