Dr.Chetan vs Shwetha

Madras High Court|24 February, 2017

JUDGMENT / ORDER

The trial in the O.P. has already commenced and P.W.1's evidence is in progress and it was posted for cross-examination of P.W.1. On a perusal of the docket orders of the trial Court, it is seen that the Presiding Officer has stated on 10.02.2017 as follows: "Petitioner absent. Respondent present. The Court learnt that the P.W.1's cross examination, pending for too long. For P.W.1's appearance and cross completion NFA by 08.03.2017."
At this stage, the respondent in the O.P., i.e. the husband, has moved this Court for a direction to expedite the disposal of the original proceedings in a time bound manner. As the learned Family Judge has already taken note of the delaying tactics of the respondent (petitioner therein), it requires no specific direction from this Court. However, the learned trial Judge is directed to dispose of the said O.P. as expeditiously as possible. With this direction, the Civil Revision Petition is disposed of. No costs.
