Dr.A.Sugirtha Rani vs The Secretary To Government

Madras High Court|12 June, 2017

JUDGMENT / ORDER

The petitioner has miserably failed to make out a case for issuance of a direction to the respondents to consider her representation dated 3.6.2017. The reason is that when the petitioner is working as Assistant Professor Stage 3 in Periyar University from 2005 and is entitled to be promoted as Associate Professor Stage 4, it is clearly admitted before this Court that till date, none of her juniors has been promoted to the said post overlooking the seniority. Now the apprehension of the petitioner is that the respondents are contemplating to consider her juniors, namely, Dr.M.Vakkil and Dr.V.Vaithianathan etc., for the promotional post of Associate Professor Stage 4. When the respondents have not admittedly passed any order granting promotion to any Assistant Professor, it is not known how the petitioner can come to this Court on mere surmises and assumptions. Therefore, this Court is not inclined to entertain the writ petition, as there is no cause of action. Accordingly, the writ petition is dismissed. Consequently, W.M.P.No.15738 of 2017 is also dismissed. No costs.
