JUDGMENT / ORDER

The petitioner has approached this Court seeking to quash Ext.P4 to the extent that it does not allot and admit him in the MDS seat in the Speciality of Orthodontics in the Government Dental College, Kozhikode by extending the benefit of Clause XI (B) (iii) of Ext.P3. It is not in dispute that the petitioner is also a person eligible to get the benefit of the aforesaid clause but the same was not extended by the 2nd respondent on account of the fact that there was a direction in W.P.C.No.11839 of 2014 to reserve one seat on account of the contentions urged by the petitioner in that case. By a separate order, I have already dismissed the said writ petition, as a result of which, the said interim order stands vacated.
2. In the result, the petitioner is also a person eligible to get admitted for the MDS seat in the Speciality of W.P.C.No.12431/2014 2 Orthodontics in the Government Dental College, Kozhikode. However, his eligibility has to be considered taking into consideration whether there are other claimants as well.
Under these circumstances, this writ petition is disposed of directing the 2nd respondent to consider the claim of the petitioner for MDS seat in the Speciality of Orthodontics in the Government Dental College, Kozhikode by extending the benefit of Clause XI (B) (iii) of Ext.P3 in the next round of allotment.
