JUDGMENT / ORDER

The petitioners were appointed as Assistant Professors in various departments, viz., English, History, Economics, Commerce, Mathematics, Botany, Zoology in the third respondent college and they joined the service on 17.10.2016, 21.10.2016, 25.10.2016 respectively. As they were fully qualified to the said post with educational qualification of M.A., M.Phil., Ph.D., the third respondent college, being a private minority educational institution, is entitled to appoint any one in the sanctioned post without any prior permission, from the authorities concerned for making the appointment, sent suitable proposals to the Manonmaniam Sundaranar University, who also considering the educational qualification of the petitioners approved the same. Thereafter, the third respondent has also reported the same to the second respondent with a request for approval of the appointment of the petitioners with the recommendation of the University. Since the respondents 1 and 2 have not passed any orders, in spite of approval of educational qualification of the petitioners by the Manonmaniam Sundaranar University they are all working without salary.

In similar circumstances, this Court, taking note of the fact that the Manonmaniam Sundaranar University had already granted the educational qualification approval, directed the respondents to pay the salary till such time the order of approval is granted. Therefore, in the present cases, since the Manonmaniam Sundaranar University, has already granted the educational qualification approval on 01.03.2017, to all the petitioners, this Court, taking into account that they were all appointed only in the sanctioned posts directs the respondents to pay the salary till the 2nd respondent passes order granting approval, within a period of four weeks from the date of receipt of a copy of this order. With the above direction, all the writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
