State At the instance of the Drugs Inspector, Shivamogga Circle, Represented by the State Public Prosecutor, High Court of Karnataka, Bengaluru – 560001. ... Respondent (By Sri.Vijaya Kumar Majage, Addl. SPP) This Criminal Petition is filed under Section 482 of Cr.P.C., praying to quash the entire proceedings in C.C.No.1265/2012 pending on the file of the J.M.F.C.-II, Shivamogga registered on the private complaint filed by the Drug Inspector of Shivamogga Circle and etc.
This Criminal Petition coming on for Admission this day, the Court made the following:
O R D E R Learned counsel for the petitioner files a memo seeking to withdraw the petition.
2. The said Memo reads as under;
“The undersigned advocate for the petitioner respectfully submits that, on 23.05.2013 this Hon’ble Court granted interim stay and issued the notice regarding admission, but on 23.05.2014 itself the above said case was disposed off convicting the petitioner, the case status of trial Court is enclosed along with this memo, hence the above said petition not survive, hence permitted to withdraw the same in the interest of justice”.
3. In view of the said memo, petition is dismissed as withdrawn.
