Learned counsel for the petitioner is permitted to delete prayer no.1 from the prayers clause during the course of the day and implead Director General/Director (Administration), Medical and Health Services, U.P. Lucknow as respondent no.3.
Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondents.
In so far as prayer no.2 is concerned it is argued by counsel for the petitioner that at present petitioner is working in district Etah and his wife is working in district Agra.
In this view of the matter, it is argued that as per the Government Order issued from time to time petitioner is also entitled for his transfer from Etah to Agra.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is permitted to make a fresh representation ventilating all his grievances before the newly added respondent no.3 along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no.3 is directed to pass appropriate order in accordance with law within a further period of two months.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
