Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondents.
By means of this petition petitioner has assailed the order of transfer as contained in Annexure-4 to the writ petition.
Contention of the learned counsel for the petitioner is to the effect that by order dated 6th June,2013 he was transferred from Etah to Aligarh and in compliance thereof, petitioner has already joined and his services for the last about one year have been satisfactory. Even the superior officer to the petitioner has also appreciated his work and has recommended for his continuance at the present place of his posting. Impugned transfer order has been passed by the State authorities even without looking into the fact that the petitioner is about to retire within next two years.
Having regard to the fact that the petitioner has complied with the order of transfer dated 6th June, 2013 and his services have also been satisfactory and he is to retire within next two years, it is provided that until next date of listing impugned order of transfer Annexure-4 to the writ petition shall not be implemented and the petitioner shall be allowed to work and paid salary.
Counter affidavit may be filed by the next date.
