Land to an extent of Ac. 0.15 cents ( 141 sq meters ) in Survey No.
1038-A-2-A and 1038-A-1-A, Kovvur village and mandal, Nellore district belonging to the petitioner was acquired by National Highway Authority of India. In this writ petition the grievance of the petitioner is that he is owner and possessor of land to an extent of Ac.18.05 cents in said survey numbers adjoining to the acquired land and respondents are trying to encroach upon the said land without following due process of law.
Third respondent filed counter affidavit. In para 11 of the counter affidavit third respondent asserted that the authorities are only utilizing the land which was acquired and are not trying to occupy or utilize the land which was not acquired. It was further asserted that “it is reiterated that the NHAI will not interfere with the possession of the petitioner’s land without giving notification and in the absence of land acquisition proceedings. If the petitioner’s land is required for public purpose, necessary notifications would be given for acquisition and due process of law will be followed.”
Having regard to the above assertions made in the counter affidavit, no further orders are required to be passed in the writ petition. Accordingly, the writ petition is disposed of. No costs. Sequel to the same, miscellaneous petitions, if any stand dismissed.
