(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Learned AGP Mr. N.J. Shah is directed to file an affidavit-in-reply to explain as to when the State has received the Resolution No. 69 of 2005 dated 11th February, 2005 passed by the Town Planning Committee and the Resolution No. 78 of 2005 passed by the Ahmedabad Municipal Corporation, which were filed by the appellants/petitioners along with the Rejoinder Affidavit in the writ petition. Learned AGP is further directed to file reply specifically stating that when the Commissioner has recommended to the State Government for cancellation of the aforesaid Resolutions and also to specifically state that , if, any order has been passed, then, the same shall be placed on record along with the affidavit-in-reply and, if , no order is passed, to explain, as to why no order is passed since last more than five years.
Learned Advocate Mr. Himanshu K Patel appearing for the respondent No.2 Corporation states that since the aforesaid Resolutions were produced along with the affidavit-in-rejoinder, the Corporation did not get any opportunity to deal with the same at the time of filing the affidavit-in-reply in writ petition. Learned Sr. Advocate Mr. Prashant G. Desai appearing for the respondent No.2 Corporation seeks time to file further affidavit-in-reply meeting with the assertions, that may be made in the affidavit-in-reply by the respondent - State of Gujarat.
The reply shall be filed within three weeks from today and thereafter two weeks time is granted to file rejoinder, if any.
