Court No. - 39
Case :- WRIT - A No. - 16011 of 2018 Petitioner :- Dr. (Smt.) Sunita Mishra Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Uma Nath Pandey,Shri Ashok Khare, Senior Advocate Counsel for Respondent :- C.S.C.,Shiv Nath Singh
Hon'ble B. Amit Sthalekar,J. Hon'ble Jayant Banerji,J.
Heard Sri Ashok Khare, learned Senior Counsel assisted by Sri Uma Nath Pandey, learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Prakash Padia, learned counsel for respondent nos. 2, 3 and 4.
The petitioner in the writ petition is seeking quashing of the order dated dated 7/9 July 2018 whereby she has been transferred from Etawah to Farrukhabad as Scientist (Home Science).
Against her transfer, the petitioner has raised several grounds namely that her husband is Lecturer in Theosophical Inter College in Etawah and her three children are also studying in the same College and that one daughter is also a heart-patient although the medical certificate is of the year 1999. The fact, however, remains that the petitioner was posted in the Agricultural Science Centre, Etawah in 2005 and has remained there till date. This means that the petitioner has remained at Etawah for more than 13 years.
Considering all these facts, we do not find any illegality or infirmity in the impugned order.
The writ petition lacks merit and is, accordingly, dismissed.
