Heard Sri Vinit Mishra, learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents.
Present petition has been filed seeking direction to the Director, Ayurvedic Services, Uttar Pradesh, Lucknow to take action on the application of the petitioner dated 1.3.2019 and also direct the concerned respondents to release pension and other post retirement dues to the petitioner and also to take appropriate decision on the letter of the Chief Medical Officer, Chandauli dated 05.3.2019 in accordance with law within a time bound period.
Grievance of the petitioner is that he has retired from the post of Medical Officer (Community Health) on 31.8.2018 and even after his retirement he is not being paid pension and other retiral dues. Drawing attention to letter dated 5.3.2019 written by the Chief Medical Officer, Chandauli to respondent no.3-Director, Ayurvedic Services, Uttar Pradesh, Lucknow he pointed out that the matter is pending before the respondent no. 3 and a representation has also been given by the petitioner by registered post to the respondent no. 3 raising his grievance.
Learned Standing Counsel submits that at the first instance, the grievance of the petitioner can be suitably looked into by the respondent no. 3, Director, Ayurvedic Services, Uttar Pradesh, Lucknow.
Accordingly, present petition stands disposed of with a direction to the respondent no. 3, Director, Ayurvedic, Uttar Pradesh, Lucknow to decide the representation of the petitioner preferably within a period of three months from the date of production of certified copy of this order before him.
The petitioner is at liberty to file fresh representation before the respondent no.3, Director, Ayurvedic, Uttar Pradesh, Lucknow.
It is made clear that this Court has not considered the merits of the claim of the petitioner, which shall be considered by authority concerned while considering the claim of the petitioner on its own merits.
With this observation, present petition stands disposed of.
