Heard Sri V. K. Dixit, learned counsel appearing for the applicant and Sri Syed Ali Murtaza, learned A.G.A.
Learned counsel appearing for the applicant referred to the order dated 13.12.2021 passed in Writ Petition (Criminal) No. 197 of 2021 wherein Hon'ble Supreme Court has held that "considering the above, in the interest of justice and in exercise of power under Article 142 of the Constitution of India, we direct release of the petitioner on bail to the satisfaction of the concerned Trial Court on the same terms and conditions as specified by the High Court of Judicature at Allahabad dated 20.09.2021 in respect of all the FIRs registered against the petition in the State of Uttar Pradesh".
Thus, learned counsel appearing for the applicant states that since the applicant has been allowed on bail by the Hon'ble Supreme Court, the present application has become infructuous and the same may be dismissed as such.
Sri Murtaza, learned A.G.A. did not dispute this fact.
In view of the aforesaid, the application is dismissed as having become infructuous.
