Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The present application under Section 482 Cr.P.C. has been filed for deciding the Case No. 2337 of 2018 (State vs. Surendra @ Vaibhav) arising out of Case Crime No. 507 of 2013, under Sections 392, 506, 323 IPC, P.S. Jani, District Meerut pending in the court of Addl. Chief Judicial Magistrate, Court No. 10, Meerut.
Learned counsel for the applicant has submitted that against the applicant first information report was lodged by opposite party no. 2 Soni Singh. On he basis of first information report, the police made thorough investigation and submitted the charge sheet against the applicant on which the Magistrate has taken cognizance on 6.5.2016 and thereafter charges were framed against the applicant on 17.7.2018 and the case is pending for recording of evidence but no evidence has yet been recorded.
In the facts and circumstances of the case, the application u/s 482 Cr.P.C. is disposed of with the direction to the trial court to decide the Case No. 2337 of 2018 (State vs. Surendra and Vaibhav pending in the Court of Addl. Chief Judicial Magistrate, Court No. 10, Meerut as expeditiously as possible after giving opportunity to both the parties preferably within a period of eight months provided there is no legal impediment in concluding the said case.
