THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Sri Patel D. Kare Gowda, learned counsel for the petitioner.
Sri Sridhar N. Hegde, learned High Court Government Pleader for respondent Nos.1 to 4.
The petition is admitted for hearing. With consent of the learned Counsel for the parties, the same is heard finally.
2. In this writ petition, petitioner, inter alia, has prayed for the following reliefs:
(a) to consider the representations given by the petitioner vide Annexures H, J, K and L to the writ petition;
(b) To direct the respondents to hold an election to the Kunchitigara Sangha, Mysuru District, Mysuru.
3. When the matter was taken up today, learned counsel for the petitioner submitted that the relief (b) as claimed in the petition has been rendered infructuous on account of efflux of time on account of the election to the Kunchitigara Sangha in question has already been held. It is further submitted that the writ petition may be disposed of with a direction to the competent authority to consider and decide the representations submitted by the petitioner contained in annexures H, J, K and L by a speaking order.
4. On the other hand, learned High Court Government Pleader submitted that suitable action in accordance with law shall be taken on the representations submitted by the petitioner.
5. In view of the submissions made by the learned counsel for the parties and in the facts of the case, the petition is disposed of with a direction to the competent authority to consider and decide the representations submitted by the petitioner contained in annexures H, J, K and L by a speaking order after affording an opportunity of hearing to respondent No.4 within a period of two months from the date of receipt of the certified copy of this order.
6. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the Petition is disposed of.
