Learned counsel for the petitioner submits that petitioner has attained the age of superannuation on 31.07.2000 and despite the order passed twice by this Hon'ble Court with respect to take decision for payment of pension, the opposite parties are not taking decision for payment of pension of the petitioner.
This Court while entertaining the writ petition by means of order dated 31.08.2007 directed the opposite parties to take decision for the payment of pension/ provisional pension to the petitioner, but when the said order was not complied with, learned counsel for the petitioner filed second application for interim relief (C.M.A.No.110400 (W) of 2008), on which, this Court by means of order dated 05.12.2008 directed the opposite parties to pay the provisional pension to the petitioner from the next month without any further delay.
List this case in the month of July, 2012.
In the meantime, the opposite parties are directed to reconsider the case of the petitioner for payment of pension in pursuance to the recommendation of Director General of Health, U.P.,Lucknow.
