JUDGMENT / ORDER

Court No. - 39
Case :- WRIT - A No. - 20202 of 2018 Petitioner :- Dr. Surendra Kumar And 9 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Ajay Shankar,Avinash Kumar Gautam Counsel for Respondent :- C.S.C.,M.N. Singh
Hon'ble B. Amit Sthalekar,J. Hon'ble Jayant Banerji,J.
Heard Sri Ajay Shankar, learned counsel for the petitioners, Sri Mata Prasad, learned Standing Counsel for the State- respondents no.1 and 2 and Sri M.N. Singh, learned counsel for the respondent no.1.
The petitioners in the writ petition are seeking a direction to the respondents to add 250 vacancies category wise which have occurred after 2015-16 in the advertisement no. 1 of 2018-19 dated 18.5.2018 of the Medical Officer, Ayurveda in the Government Ayurvedic Hospital of U.P.
According to the petitioners vide letter dated 27.6.2018 the Government took a decision that 250 posts which had occurred after 2015-16 be filled up and a requisition was accordingly sent to the Uttar Pradesh Public Service Commission (UPPSC).
Sri M.N. Singh, learned counsel for the Commission submits that the advertisement no. 1 of 2018-19 had already been issued on 18.5.2018 and the written examination is scheduled for 30.9.2018. He further submits that the requisition of 250 posts was scrutinized by UPPSC and because there were some discrepancies, the matter has been sent to the State Government vide letter dated 21.8.2018 as per the instructions received by him and as soon as the decision will be taken by the State Government, an advertisement will be issued with regard to these 250 posts.
In this view of the matter, in our opinion, since the matter is still pending with the State Government, it would be appropriate that the State Government may take appropriate decision regarding the discrepancies which may have been raised by the UPPSC so that the process of selection may be commenced. We, therefore, direct the Respondent no.1-Secretary, Department of Ayurvedic Services, Ayush-I, Lucknow, U.P. to take a decision in the matter with regard to the letter of the UPPSC dated 21.8.2018 expeditiously, preferably within a period of two months from the today and on the basis of such decision the UPPSC shall then proceed to take appropriate action to fill up the posts.
The writ petition stands disposed of.
