Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri S.K. Pandey, learned counsel representing respondent no. 6.
Petitioner had applied for appointment on the post of Assistant Professor Botony, pursuant to recruitment exercise initiated by notification No. 46 published by the U.P. Higher Education Service Commission, Allahabad. Petitioner has secured over all rank no. 21 and it is stated that the petitioner is placed at waiting list No. 1 in the Scheduled Caste category. Petitioner's grievance is that various selected persons have not joined and vacancies exists against which petitioner could be considered for appointment but his claim has not been examined, although various other persons from the waiting list have been selected in Botany. Various representations have been made in that regard. It is stated that a vacancy exists in respondent no. 6 institution against which petitioner's claim can also be considered.
Learned Standing Counsel submits that grievance of the petitioner shall be examined, by the authority concerned, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, in respect of his grievance annexing all relevant materials in support of his claim, alongwith certified copy of this order, within two weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned, in accordance with law, by passing an appropriate order, within a further period of three months, thereafter.
