Heard learned counsel for the applicant and the State respondent.
This transfer application has been filed praying that the proceedings of Case No. 393 of 2005 (State v Shiv Om Gangwar & others) arising out of Case Crime No. 218 of 2005 under Sections 498-A, 504 and 506 IPC and also under Sections 3/4 of the Dowry Prohibition Act, PS Kayamganj, District Farrukhabad pending before the court of the Judicial Magistrate, Kayamganj, District Farrukhabad be transferred to the court of Bareilly or Shahjahanpur or to some other adjoining district in the State of the competent jurisdiction.
Issue notice to the opposite party no. 2 returnable within four weeks. Steps be taken within a week.
Learned A.G.A. prays for and is granted four weeks time to file counter affidavit. The opposite party no.2 may also file counter affidavit within the said period. As prayed by the learned counsel for the applicant one week thereafter is granted for filing rejoinder affidavit. List after expiry of the aforesaid period.
