Heard learned counsel for the petitioner and Sri V. Singh, learned counsel for respondent no. 2.
By the present petition, the petitioner has prayed for quashing the proceeding of P.L.A. Case No. 649 of 2013 (Nagendra Singh and others Vs. Dr. Shisher Jaiswal and other) pending before Permanent Lok Adalat, Azamgarh.
Considering the nature of proposed order, there is no need to issue notice to private respondents.
The case of the petitioner is that a case was registered against the petitioner before Permanent Lok Adalat as P.L.A. Case No. 649 of 2013 and on 23.5.2018, the case was fixed for final argument. On being query made by the Court about order passed on 23.5.2018, learned counsel for the petitioner only informed that another date has been fixed but final hearing could not take place. He has not annexed the order passed on 23.5.2018 along with petition.
Learned counsel for the petitioner contended that proceeding pending before Permanent Lok Adalat in P.L.A. Case No. 649 of 2013 may be stayed.
After going through the record, it is clear that the case is ripe for final hearing before Permanent Lok Adalat and only within one or two hearings, the case may be decided, therefore, at this stage, there is no occasion to stay the proceeding pending before Permanent Lok Adalat, Azamgarh.
The petition is disposed of with direction to Permanent Lok Adalat, Azamgarh to decide the case expeditiously, preferably within a period of six months from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties and if any adjournment is granted, reasons shall be recorded for the same.
It is made clear that this Court has not adjudicated the matter on merits.
