Petitioner was selected on the post of Lecturer pursuant to an advertisement published by the Higher Education Service Commission, Allahabad. A placement order was issued in his favour on 7th December, 2004. It is alleged that because of some delaying tactics adopted by the Institution concerned, the appointment letter was issued to the petitioner only in April, 2005, by when the New Pension Scheme came into effect. Submission is that as petitioner had already been appointed during the period of the previous Pension Scheme, the placement order ought to have been treated as the relevant date for considering his entitlement to receive pension. The matter in that regard has been represented by the petitioner and the issue has been referred to the Director on 13th October, 2018. Grievance is that the Director has not taken any decision so far in the matter.
Learned Standing Counsel states that an appropriate decision would be taken by the Director in accordance with law.
In the facts and circumstances, noticed above, this petition stands disposed of requiring the respondent no. 2 to take an appropriate decision upon the petitioner's representation, as noticed above, within a period of three months from the date of presentation of a certified copy of this order before him.
