JUDGMENT / ORDER

Learned counsel for the applicant fairly submitted that as per statute 18.02 of Lucknow University, it is the duty of Registrar to prepare and maintain seniority list of teachers of the University. In this background, Shri Shashi Prakash Singh, learned counsel for the applicant prays that he may be permitted to delete opposite party no. 2 from the array of opposite parties.
Prayer of learned counsel for the applicant is accepted.
Learned counsel for the applicant is permitted to delete opposite party no. 2 from the array of opposite parties, during the course of the day.
Heard learned counsel for the applicant.
Learned counsel for the applicant alleges non-compliance of order of writ Court dated 17.02.2014 passed in Writ Petition No. 949 (SB) of 2012 (Dr. Seshu Lavania Vs. State of U.P. and others), whereby a direction was issued to the University to finalize the seniority list within a period of three months.
Submission of learned counsel for the applicant is that copy of the order of writ Court was served in the office of Vice Chancellor as well as Registrar on 24.02.2014 followed by reminders dated 31.03.2014 and 25.04.2014, but nothing has been done by opposite party. Therefore, the applicant is constrained to approach this Court by means of present Contempt Petition for initiating proceedings against opposite party under the provisions of Contempt of Court Act for willful disobedience of the order of Writ Court dated 17.02.2014.
On due consideration, prima facie, a case of willful violation of the the order of writ Court is made out.
Let notice be issued to opposite party to appear before this Court on 11.08.2014 to show cause as to why proceedings be not initiated against him under the provisions of Contempt of Court Act for willful disobedience of the order of writ Court dated 17.02.2014 passed in Writ Petition No. 949 (SB) of 2012 (Dr. Seshu Lavania Vs. State of U.P. and others).
It is provided that if order of the writ Court is complied with and compliance report is filed, the opposite party need not appear before this Court on the date fixed.
