Heard Shri Kailash Singh Kushwaha, learned counsel for the petitioner and the learned standing counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents to allow him to continue to discharge his duties as Medical Officer in the Joint District Hospital, Manjhanpur, Kaushambi. The contention of the petitioner is that on the request made by the Chief Medical Superintendent, Manjhanpur, by an order dated 4.8.2018 passed by the respondent no. 2-Addl. Director, Medical Health and Family Welfare, Allahabad Division, Allahabad, the petitioner has been posted at Joint District Hospital, Manjhanpur, Kaushambi. At present the petitioner is posted at Community Health Centre, Kada District Kaushambi.
We do not find any good ground for interference in the writ petition as it is for the respondents to post the petitioner wherever they feel the necessity of work requires his posting. However, if the petitioner has any grievance, he may approach the respondent no. 2-Addl. Director, Medical Health and Family Welfare, Allahabad Division, Allahabad.
This writ petition is therefore disposed of with a direction that if the petitioner prefers a representation raising all his grievances as raised in the present writ petition before the respondent no. 2-Addl. Director, Medical Health and Family Welfare, Allahabad Division, Allahabad within fifteen days from today alongwith the certified copy of this order, the respondent no. 2 shall consider and decide the same in accordance with law within a further period of one month.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
