Heard learned counsel for the petitioner and Sri J.S. Bundela learned Standing Counsel for the State.
This petition impugns the order dated 28 December 2018 pursuant to which the prayer of the petitioner for extension of his tenure appointment has been negatived.
The ground taken in the impugned order is that various complaints with respect to the work and conduct of the petitioner had been received and as a consequence of which the respondents have found it inexpedient to extend his tenure appointment. Since the engagement of the petitioner was evidently contractual in nature, the Court finds no ground to entertain the challenge to the same bearing in mind the principles enunciated by a Division Bench of this Court in Rajesh Bhardwaj Vs. Union of India (Writ A No. 54840 of 2013). Insofar as the challenge to the appointment of the third respondent is concerned, this Court notes that even on the earlier occasion, although submissions in this respect were addressed, the same were negatived bearing in mind that the private respondent had been engaged on the post of Junior Resident whereas the petitioner had been appointed as a Senior Resident.
On an overall conspectus of the aforesaid facts, the Court finds no merit in this petition which shall stand dismissed.
