Heard Mr. G.P. Mishra, learned counsel for the applicant and the learned A.G.A. for the State.
The application under Section 482 Cr.P.C. has been filed challenging the summoning order dated 10.10.2017, passed by the Additional Chief Judicial Magistrate, Court No. 3, Bulandshahr in complaint Case No. 1144 of 2016 (Smt. Ruchi Bansal Vs. Sapna and Others), whereby the complaint case has been rejected by the Magistrate in terms of Section 203 Cr.P.C. as well as the order dated 17.4.2018, passed by the Additional Session Judge, Court No. 7 Bulandshahr in Criminal Revision No. 543 of 2017 (Smt. Ruchi Bansal Vs. State of U.P. and Others), whereby the aforesaid revision filed by the applicant challenging the order dated 10.10.2017 has been dismissed.
Having heard the learned counsel for the applicant and upon perusal of the orders impugned in the present application, I do not find any illegality having being committed by the Magistrate or the Revisional Court in dismissing the complaint as well as the revision filed by the applicant.
The findings recorded by the Magistrate as affirmed by the Revisional Court, could not be dislodged as being illegal, perverse or erroneous. No jurisdictional error could be pointed out in the exercise of jurisdiction by the revisional court.
For all the reasons given herein above, there is no scope in this criminal misc. application. Accordingly, the present application fails and is, consequently, dismissed.
