The orders of rejection of the application seeking grant of license for gun of the petitioner's father has been rejected by the licensing authority as also the appellate authority. A categorical finding of fact has returned by both the authorities that the petitioner had given a wrong information in the affidavit dated 23.4.2016 submitted along with her application form.
In the police report, a reference of two criminal cases being lodged against the petitioner's husband has been made to state that the petitioner had concealed the said information. The contents of the said report is admitted to the learned counsel for the petitioner. However, only explanation being offered by the petitioner is that she was not well aware of the procedure for moving the application. In case, any information has not been disclosed therein it was the wrong act of the counsel who had filled the application form. This submission of the petitioner cannot be accepted to assail the orders impugned. The affidavit dated 23.4.2016 was sworn by the petitioner and while doing so, she had concealed the information regarding the criminal cases lodged against her husband. Whether the said information was deliberately avoided or it was inadvertent act is not open for examination in the present petition, inasmuch as, this Court cannot take a different view from what has been taken by the competent authority, on the material before it.
The present petition is, accordingly, dismissed.
